i had posted this on themeforest, realized that the themolitor forum was the preferred contact point and double posted...
regardless
i answered my own question
after dicking around with it, installing it on two separate installations etc, that one install did the nasty and one didn't regardless of plugins and other variables
so i just reloaded the theme and it self-corrected...

Hey there, I'm looking at the demo site on my iPad 1 and it's not repeating at all. Can you try the demo on yours and let me know if it's doing the same thing for you?

Please send a screencap as well (holding down the home + power button).

on an iPad - the footer copyright text is repeated under the colored bar -- anyway to fix that?
